A Petition for Review having been filed on May 10, 2001, by Leighton E. Reutn, Lay Advocate, on behalf of Morris Duane Buckles, defendant, from a denial of a Motion to Dismiss, dated February 7,2001 1, the Honorable Barry C. Bighorn st., presiding, and good cause appearing:

IT IS NOW THEREFOR THE ORDER OF THIS COURT THAT:

  1. Based upon the papers filed by Appellant, this Court could not determine any legal basis upon vtfiich to review the lower court judgment, therefore, the Petition is denied.
  2. Donald Clark and Danna Runs Above are appointed as Co-Guardians of the person and estate of Joseph Clark, effective immediately.

[1] Appellant contends that he was net served with the Court's order until April 23,2001, therefore the time to file his Petition for Review commences on that date. The plaintiffs/appellees do not contest this contention in their response filed May 15,2001 Therefore this Court recognizes the Petition as timely.
