OPINION

COMES NOW the Fort Peck Tribal Court of Appeals on its own and issues the following order to dismiss this action. Dismissal is based on the fact that the Appellant herein failed to file a brief in support of appeal and also failed to attend oral arguments on December 6, 1996. As of the date of this writing Appellant has failed to prosecute the claim set forth in the Notice of Appeal.
NOWTHEREFORE IT IS THE ORDER OF THIS COURT that this matter be dismissed and the lower court decision is hereby AFFIRMED.DATED this 4th day of September, 1997.
