WITHDRAWAL OF APPEAL

COMES NOW the defendant/appellant, and with his counsel, Mary L. Zemyan, gives notice of his withdrawal of his appeal filed herein on March 7, 1995, due to the following facts:
- Part of the sentence included the seizure of defendant's rifle for a period of six (6) months.
- The six-month period has elapsed and the defendant has need for his rifle in that he uses it to provide meat for his family
- Defendant was also sentenced to pay a fine.
The rifle was a .270 Savage with a Redfield scope and a gun case.
