COMES NOW; Fort Peck Court of Appeals and makes the followings Upon motion of the Appellant herein and good cause appearing it is hereby ordered that this appeal is dismissed based on the fact presented to this court that the parties are going forward with this matter in the tribal court.

Appellant filed a SUPPLEMENTAL BRIEF in this matter on or about October 13, 1994 requesting a stay of further action on this appeal provided she is allowed to proceed on the claim pending before the Tribal Court. It appears to the court that both parties have made an appearance in Tribal Court on new claims filed by appellant and Tribal Court is proceeding on the merits of the case and the bases of the appeal is moot and withdrawn by appellant.
