THIS MATTER comes before the Appeals Court on a Notice of Appeal of Denial of Probable Cause Hearing and Request for Stay of jury Trial filed by Austin Barr, Defendant. The Court having considered the Notice of Appeal does hereby deny the Appeal for the following reason:

I CCOJ Section 202 - Jurisdiction of Court of Appeals provides as follows:

The jurisdiction of the Court of Appeals shall extend to all appeals from final orders and judgments of the Tribal Court.

There being no final order or judgment of the Tribal Court in this matter, the Appeal is denied and the matter remanded to Tribal Court.
