ORDER

PER CURIAM

The above-entitled matter having come before the Appeals Court on an application for Writ of Habeas Corpus, the Petitioner, Iris Allrunner, appearing Pro Se and with the Defendant, Austin Barr; the Fort Peck Tribes being represented by Enunett Buckles, Prosecutor.

Upon hearing the testimony presented at the show cause hearing held on June 10, 1992 and having reviewed the file herein, and for good cause shown, IT IS HEREBY ORDERED as follows:

Defendant, Austin Barr, is released on his own recognizance pending trials, with the following conditions:

  1. Defendant is released to the custody of his mother, Iris Allrunner, and is to reside at the residence of Iris Allrunner.
  2. Defendant is to refrain from use of alcohol/drugs unless prescribed by physician
  3. Defendant is to remain within the exterior boundaries of the Fort Peck Indian Reservation, except that if Defendant is on a fire fighting crew, he may respond to fires as called. Defendant or Iris Allrunner is to advise the Court by the next working day following a fire
  4. Defendent is to obey all laws of the juristiction of his presence.
  5. Defendent is to appear at all scheduled Court appearances as notifed by Court or Procecutor.
