The above matter having come before the Court on a Motion for Summary Judgment filed by Appellant, Wanda Smith, and in a combined Motion for Dismissal or Rehearing filed by the Tribal Special Prosecutor; and the Court having considered the Motions.
IT IS HEREBY ORDERED that the extradition proceedings against Appellant Wanda Smith are dismissed without prejudice, due to defects in the prosecution of said matter as stated in Appellee's Motion.
