This matter having come before the Appeals Court by NOTICE OP APPEAL filed from a court sentence entered on October 30, 1990;
This matter was duly set for briefing schedule before the Appeals Court; however, the Counsel of record for Defendant/Appellant did not file any brief, memorandum or statement of issues as ordered by the Court.
THEREFORE, it is the finding of this Court that said Appeal Notice is without merit and IT IS HEREBY ORDERED that said appeal be, and the same IS HEREBY DISMISSED.
IT IS FURTHER ORDERED that said matter is remanded to Fort Peck Tribal Court for purposes of execution of sentence.
