ORDER DISMISSING APPEAL

THIS COURT issued an Order Postponing the Date and Time for Oral Arguments on Appellant's issue no.,2 until such time as the entire Court of Appeals had met to determine whether to hear or also dismiss issue no. 2. This issue reads as follows:
"2. Did Appellee's attorney violate Canon 6 and Canon 1 of the Fort Peck Code of Ethics for Attorneys and Lay Counselors by opposing Appellant William Youpee in this action when Appellee's attorney still represents William Youpee in an action currently before the Fort Peck Tribal Court, to wit: Florence Youpee v. Norman Hollow. Stanley Yellowrobe. Pearl Hopkins. Dean Blount. Tom Excarceqa. William Youpee. and Alpheus Bighorn. Sr. AKA A&S Tribal Industries Board of Directors, in which Appellant William Youpee is a named Defendant?"
The Court having met and discussed whether to schedule oral arguments have determined that since the matter has been settled and issue no. 2 was raised therein, the entire matter should be dismissed, however, without prejudice in the event appellant wishes to proceed with filing a formal complaint against Mr. Irving.
THEREFORE, IT IS HEREBY ORDERED THAT AS TO ISSUE NO. 2, THIS MATTER IS ALSO DISMISSED, HOWEVER, WITHOUT PREJUDICE.
